What Talent Agreement Services Does Brodsky Law Offer?
Talent agreements are the contracts that define the professional relationships between artists, performers, and the managers, agents, producers, and companies they work with. These agreements — from management contracts and agency agreements to performer employment deals and endorsement contracts — determine compensation structures, creative controls, exclusivity provisions, and the duration and termination of professional relationships. For artists and performers, the terms of these agreements can define the trajectory of their careers and their ability to control how their name, image, and creative work are used. Sasha Brodsky has represented talent and entertainment professionals in Santa Cruz and throughout California since 1998.
California provides significant statutory protections for talent that distinguish it from other jurisdictions. The California Talent Agencies Act (Labor Code Section 1700.4 et seq.) requires that any person or entity procuring employment for an artist must be licensed by the California Labor Commissioner — and agreements entered into by unlicensed talent agents may be voidable. The seven-year rule under Labor Code Section 2855 limits the enforceability of personal service contracts to seven years, providing talent with a statutory exit from long-term agreements. SAG-AFTRA agreements establish minimum compensation, working conditions, residual payments, and other protections for performers in union productions. Management agreements, while not subject to the same licensing requirements as agency contracts, must be carefully structured to define the manager's role, commission structure, and post-term rights. Sasha works to protect his clients' careers and compensation through careful contract drafting, review, and negotiation.
